TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use (“Agreement”) govern your use of Shira Gill LLC’s website, communications, offerings, and all related materials (collectively, the “Offering”). This Agreement is legally binding, so please read it carefully before purchasing your ticket or participating in the event.

1. Introduction

• Parties:
  This Agreement is between you (“Attendee”, “You”, “Your”) and Shira Gill LLC (“Company”, “We”, “Us”, “Our”), based in San Francisco, California.

2. General Provisions

Payment & Refunds:

• Payment in full is required at the time of registration.
• All payments are non-refundable.
• If the event is unable to take place on the originally scheduled date, it will be rescheduled to a later date.

Cancellations and Ticket Transfers:

• If you are unable to attend the retreat, your ticket is nonrefundable. However, you may request to transfer your ticket to another individual. Please note that Shira Gill LLC is not responsible for finding or securing a replacement attendee on your behalf; the decision to approve a transfer is solely at our discretion.
• Shira Gill LLC is not responsible for any travel or additional expenses.

3. Health and Safety (COVID-19)

• Assumption of Risk:
  By registering for the retreat, you acknowledge and accept the inherent risks associated with travel and group events.
• Health Responsibility:
  All attendees, speakers, staff, and vendors are responsible for monitoring their own health and taking appropriate safety precautions to protect themselves and others.
• Liability Release:
  By participating, you release Shira Gill LLC and all associated parties from any liability related to health risks, including those posed by COVID-19.

4. Inclusion Policy

• Commitment to Diversity:
  Shira Gill LLC is dedicated to maintaining a safe, supportive, and inclusive environment for all.
• Zero Tolerance:
  We enforce a zero-tolerance policy toward hateful, discriminatory, or racist behavior. Any attendee found engaging in such conduct will be asked to leave immediately without a refund.

5. Liability Policy

• Limitation of Liability:
  In no event shall Shira Gill LLC be liable for any special, consequential, indirect, or incidental damages (including lost profits) arising from the retreat or this Agreement, regardless of whether the claim is based on contract or tort.
• Exceptions:
  This limitation does not apply to:
  1. Damages resulting from Shira Gill LLC’s gross negligence or willful misconduct.
  2. Claims covered by applicable insurance.

6. Indemnification

• Your Responsibility:
  As an Attendee, you agree to indemnify, hold harmless, and defend Shira Gill LLC and its respective officers, agents, and employees (collectively, “Indemnitees”) from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:
  • Bodily injury or death,
  • Damage or loss of property,
  • Any negligent or willful acts or omissions on your part.
• Scope:
  This indemnification applies to any claim arising under applicable laws or as a result of your non-compliance with this Agreement.

7. Use of Recreational Facilities

a. Assumption of Risk: By using the property’s pool, hot tub, and outdoor areas, you acknowledge and assume all risks associated with their use, including but not limited to slips, falls, drownings, or any other injuries or damages.

b. Release of Liability: Shira Gill LLC shall not be liable for any injury, loss, or damage incurred by you or any guest arising out of or in connection with the use of the aforementioned recreational facilities. By using these areas, you hereby release and discharge Shira Gill LLC, its officers, agents, and employees from any claims or liabilities related to your use of these facilities.

c. Safety Guidelines: You agree to adhere to all posted safety guidelines and any instructions provided by Shira Gill LLC regarding the proper use of the pool, hot tub, and outdoor areas. Shira Gill LLC does not provide lifeguard or supervisory services in these areas, and it is your responsibility to use these amenities in a safe manner.

d. Medical Emergencies: In the event of a medical emergency arising from the use of the recreational facilities, you are responsible for seeking prompt medical attention. Shira Gill LLC shall not be responsible for any delays or complications in the provision of medical care.
